Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the AI generation service operated by Design N Studio (“Designn,” “we,” “us”). By accessing or using the service, you agree to these Terms. If you do not agree, do not use the service.

You must be at least 13 years old (or the minimum age in your jurisdiction) and able to form a binding contract. You are responsible for activity under your account and for keeping your Google sign-in secure. You agree to provide accurate information and to comply with these Terms and all applicable laws.

Designn is a creative tool for producing marketing and commercial video and imagery — ads, commercials, and product and brand content — from prompts and media you provide, using third-party AI models. The service is provided on an ongoing, evolving basis; features, models, and credit pricing may change, and the service may be offered in beta or preview form.

• You must own or have the rights and permissions necessary to use any prompt, image, video, likeness, trademark, or other material you submit.
• You may not submit content that is illegal, infringing, defamatory, or that violates anyone’s privacy or intellectual-property rights.
• You are responsible for ensuring your inputs and your use of the outputs comply with applicable law and with the policies of the underlying model providers (e.g. Replicate, fal.ai, and the model owners they route to).
• We may send your inputs and outputs to those providers to operate the service, and may remove content or suspend accounts that we believe violate these Terms.

As between you and us, you retain whatever rights you have in the content you generate, subject to these Terms and to the terms of the underlying model providers. You grant us a limited license to host, store, process, and display your content as needed to operate and improve the service. Note that AI outputs are generated from shared models and may not be unique — similar outputs may be produced for other users — and some models may embed provenance signals or watermarks (e.g. SynthID).

You agree not to:

• Create deepfakes, face swaps, or any content that uses a real person’s face, voice, or likeness without their explicit consent, or that is intended to deceive others about who created or appears in it;
• Use the service to create unlawful, harmful, harassing, hateful, or sexually exploitative content, or content that impersonates others or infringes their rights;
• Attempt to reverse engineer, disrupt, overload, or circumvent the limits or security of the service;
• Resell, abuse, or automate access to credits or generations beyond what the service permits; or
• Violate the usage policies of the underlying AI providers.

We may remove content and suspend or terminate accounts that we believe violate these restrictions, including any use of the service to generate deepfakes or unauthorized likenesses.

Generations consume credits. Credits and any associated balances are part of the service, have no cash value, and are non-transferable. Except where required by law, credits and any fees are non-refundable. We may change credit pricing and allocations at any time.

AI-generated outputs may be inaccurate, offensive, incomplete, or may unintentionally resemble existing works or real people. We do not warrant that outputs are accurate, original, non-infringing, or fit for any particular purpose. You are solely responsible for reviewing and for how you use any output.

THE SERVICE AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DESIGNN AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR ANY OUTPUTS. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE THREE MONTHS BEFORE THE CLAIM OR USD 50.

You agree to indemnify and hold harmless Designn and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your content, your use of the service, or your violation of these Terms or of any law or third-party right.

You may stop using the service at any time. We may suspend or terminate your access if you violate these Terms or to protect the service or other users. Provisions that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above. Your continued use of the service after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the Republic of Korea, without regard to its conflict of laws rules, and you agree to the exclusive jurisdiction of the courts located there, except where applicable law provides otherwise.
